This policy is part of the TrustPoint Analytics website terms and may be incorporated into accepted services where applicable. Read it together with any Accepted Scope or signed agreement.
1. Acceptance
By accessing or using this website, you agree to these Website Terms of Use and the Privacy Notice. If you do not agree, do not use the website. These terms govern website use; accepted laboratory work is also governed by the Testing Services Terms, applicable quotation, work order, and incorporated policies.
2. Eligibility and authority
You must be at least 18 years old and legally capable of agreeing to these terms. If you use the website for an organization, you represent that you have authority to act for that organization and bind it where applicable.
3. Informational purpose
Website content is general information about analytical services and does not constitute medical, clinical, legal, regulatory, scientific, quality-system, investment, or other professional advice. Service descriptions are not guarantees of availability, method suitability, accreditation scope, turnaround, or outcome. A service exists for a project only when TrustPoint accepts it in writing.
4. Permitted use
You may use the website for lawful internal evaluation of TrustPoint’s services, legitimate project intake, report verification, support, and communication. Limited printing or saving for those purposes is permitted if notices remain intact.
5. Prohibited use
- Submit unlawful, misleading, malicious, infringing, or unauthorized information.
- Attempt to access another person’s project, report, account, record, system, or nonpublic area.
- Interfere with website operation, security, rate limits, or authentication; introduce malware; scrape at scale; or probe vulnerabilities without written authorization.
- Impersonate another person, misrepresent authority, falsify a submission, alter a report, or present a draft as final.
- Use website content or a TrustPoint name, mark, report, or verification record to imply endorsement, regulatory approval, medical suitability, or testing beyond the stated scope.
- Use the website in connection with human or veterinary diagnosis, treatment decisions, administration instructions, or unlawful distribution of regulated material.
6. Intellectual property
The website, design, text, graphics, logos, databases, report formats, and other content are owned by TrustPoint or its licensors and protected by applicable law. Except for the limited permitted use above and rights stated in an accepted service agreement, no license is granted. “TrustPoint Analytics” and associated branding may not be used without written permission.
7. Third-party services and links
Third-party links and services are provided for convenience or operation. TrustPoint does not control and is not responsible for third-party content, availability, security, or privacy practices. Your use of a third party may be governed by separate terms.
8. Availability and changes
TrustPoint may change, suspend, restrict, or discontinue website features, content, or access at any time. TrustPoint does not guarantee uninterrupted or error-free operation, preservation of a draft submission, or continuous availability of a public registry.
9. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND PUBLIC CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTPOINT AND ITS OWNERS, PERSONNEL, CONTRACTORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, DATA, REPUTATION, OR BUSINESS; OR RELIANCE ON WEBSITE CONTENT. TRUSTPOINT’S AGGREGATE LIABILITY ARISING ONLY FROM WEBSITE USE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE A DIFFERENT LIMIT IS REQUIRED BY LAW. Service-related claims are governed by the Testing Services Terms.
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless TrustPoint and its personnel and providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful website use, content you submit, infringement, misrepresentation, altered reports, or violation of these terms.
12. Governing law and venue
These terms are governed by Florida law, without regard to conflict-of-law rules. Any dispute not subject to another written agreement must be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and each party consents to personal jurisdiction and venue there. Mandatory consumer rights remain unaffected where they cannot lawfully be waived.
13. General terms
If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these terms without TrustPoint’s written consent; TrustPoint may assign them in connection with its business. These terms and incorporated notices are the entire agreement concerning website use.
14. Changes and contact
TrustPoint may update these terms by posting a revised version and effective date. Continued use after the effective date constitutes acceptance where permitted. Use the Contact page for questions or legal notices.
